Jason Poettcker

I entered the legal profession for two reasons: to fight for justice and seek the good of those I represent. I will use the gifts and skills I have been given to zealously advocate for your cause.

Growing up in rural Alberta and starting to earn his own money by doing yard work at age 10, Jason developed a strong work ethic at an early age. After travelling and meeting his wife in Europe, working as a youth pastor in Victoria B.C., doing landscape construction for six years while completing his Bachelor’s degree in Philosophy and History in Victoria and his Master’s degree in philosophy in Toronto, selling coffee for a roaster in Toronto, and then selling advertising, Jason finally decided to settle down in Winnipeg with his wife and pursue a career in Criminal law. He is passionate about using the critical thinking and logical argument skills he learned in philosophy to understand the ideas that underpin the law and fight for justice and the good of those he represents. He articled in 2019-2020 with Manitoba Prosecution Services where he gained a wide breadth of training, knowledge, and experience prosecuting Criminal Code and provincial statute offences. He was called to the Bar in June 2020 and joined the Criminal Defence bar with Bueti Wasyliw Wiebe as an associate in June 2020 where he cut his teeth junioring on second and first degree murder trials while building his practise. He has already taken on major files of his own including a sexual assault nine year sentence and conviction appeal, drug trafficking, weapons possession, sexual assault, assualt, criminal harassment, and impaired driving. He then joined Gindin Segal Law in August 2021 and continues to expand his practise in Criminal Law.  In his spare time he enjoys discussing philosophy, reading novels, drawing, cooking, skateboarding, cycling, renovations, running, volunteering as a youth mentor, and hanging out with his wife and mini-golden doodle.

Jason’s preferred area of practise is criminal defence including provincial statute offences (Highway Traffic Act and Provincial Offences Act). He also represents clients in Parole Hearings, Prison Law, Mental Health Review Board Hearings, MPI Show Cause hearings, MPI Collision Claims, Licence Suspension Appeal Board Hearings, and Immediate Roadside Prohibition for Alcohol hearings.

  • Four successful Parole Appeals at Federal Institutions (2023)
  • Successfully negotiated with the Crown to amend a drug trafficking charge to simple possession for a 1 year probation order and a stay of proceedings on two firearms charges, and possession of property obtained by crime.
  • Got the Crown to drop a driving prohibited charge for a client by presenting case law on officially induced errors and power assisted bicycles. 
  • Convinced the Crown to drop charges for breaching a release order, weapons possession, and drug possession charges and agree to a conditional discharge for identity fraud with 6 months of probation and community service by raising multiple complex Charter issues. 
  • Wrote a Bradshaw/Khelawon Application Brief challenging the admissibility of a hearsay youth witness video statement for a second degree murder which ultimately led to an acquittal.
  • Wrote two Garofoli Application Briefs and Section 8 Charter Briefs for a first degree murder, conspiracy to commit murder, assault and utter threats in association with a criminal organization, challenging the admissibility of multiple wiretaps, production orders, and other search warrants for two co-accused. 
  • Wrote a legal article on during law school which was published in a book on International Nuclear Law: “Is Deterrence Morally and Legally Permissible and Is It a Form of State Terrorism?” [2019] in Black-Branch J., Fleck D.
